1. Acceptance of Terms
By accessing or using Clonique, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.
2. Service Description
Clonique is an AI companion application that creates digital approximations of real people based on chat exports or manual descriptions. The AI-generated responses are simulations and do not represent the actual person. Clonique is not a replacement for professional therapy or mental health services.
3. User Responsibilities
You agree to use Clonique responsibly and ethically. You must only import conversations in which you were a participant. You must not use the service to harass, stalk, or harm others. You are responsible for all content you provide to the service.
4. AI Disclaimer
All AI-generated content is fictional and may be inaccurate, biased, or inappropriate. Clonique does not guarantee that AI responses will accurately reflect any real person's views, personality, or behavior. Screenshots of AI conversations may be misleading and should not be shared as if they represent real conversations. A conversation exported from the app says on its first line that the clone’s messages were written by AI; when you share it, keep that line.
5. Data Processing
Your data is processed in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). Chat data is processed on your device; photos, videos and voice messages from the export stay only there, and a copy of the rest, encrypted with a key from your device, is also kept on our server, and on plans that remember the whole chat the conversation is also there in encrypted passages the clone searches to remember old conversations. We do not sell your data to third parties. You may request deletion of your data at any time.
6. Limitation of Liability
We work to keep Clonique running and accurate, but AI replies can be wrong and the service can at times be unavailable. We are not liable for harm from relying on AI replies or for an emotional reaction to a conversation with a clone, unless it was caused by our intent or gross negligence. For any other harm, our liability is limited to the amount you paid us in the 12 months before it. These limits do not apply to death or personal injury or to the rights consumer law gives you. If you are experiencing a mental health crisis, please contact professional crisis services immediately. Clonique also reads every message for signs of a crisis and, when it sees them, offers numbers to call; this does not replace professional help.
7. Age
Clonique is for people aged 18 or over. By using it you confirm that you are at least 18.
8. Plans and payment
Basic is free. Standard and Deep are monthly subscriptions that renew every month until you cancel them; Memorial is paid once and does not renew. The price, VAT included, and what the plan includes are shown before you pay. You cancel a subscription in the app (Settings → Account → Plan and billing), and it runs until the end of the period paid for, with no further charges. A plan bought in the App Store or Google Play is also cancelled in that store’s settings, and refunds for such a purchase go through the store. A price change does not change a subscription that is already running. As a consumer in the EU you keep every right consumer protection law gives you; for a refund or a billing question, write to support@clonique.ai.
9. Withdrawal from a purchase
You can withdraw from a paid plan bought on the web within 14 days of buying it, without giving a reason, and get the full amount back. Just write to support@clonique.ai before the 14 days are over, for example: “I withdraw from the contract for the [plan] plan bought on [date]. Name, the account’s email, date.” We refund to the same payment method within 14 days of receiving your notice, and the plan ends then. For a plan bought in the App Store or Google Play, withdrawal and refunds go through that store, under its rules.
10. Ending
You can delete your account at any time (Settings → Account → Delete account); a subscription is then cancelled at once. We may restrict or end access for an account that breaks these terms.
11. Governing law and changes
These terms are governed by Croatian law; consumers keep the protection the law of the country they live in gives them. Disputes go to the court in Zagreb, unless consumer protection law says otherwise. We announce material changes to these terms in the app or by email before they take effect.
